The Extract of Honble Tribunal"s Order for Our Contempt Petition

The Honble CAT Ernakulam Bench delivered its Order on 10-12-2014 for the Speaking Order received from Ministry of I&B for Our long pending wage anomaly issue is extracted below : 
 " The Petitioners have filed MA/180/1273/14 on 24-11-2014 producing a document dated 03-11-2014 marked as Annexure A-7 with a prayer that the same be taken on Record.Allowed.
      Though there was considerable delay in complying the order of this Tribunal,We note that.finally the Respondents,by the aforesaid order dated 09-12-2014 have complied with the order,though in a disadvantageous manner to the Petitioners. Mr.P.Santhosh Kumar.Learned Counsel for the petitioners submitted that the Contempt Petition can be closed for the time being permitting the Applicants to take resort to proper Legal remedies for redressing their grievances which are left unventilated.That request is allowed."
   Based on the above matter an urgent O.A has been prepared on 19-12-2014 by Our Federation with Consultation with our Senior Counsel and team and after December vacation of the Tribunal.,the Reply to the Ministry of I&B order dated 9-12-2014,will be filed before the Honble Tribunal in the First week of January,2015.The next update will be available after the case is listed for hearing.

SPEAKING ORDER PRODUCED BEFORE THE HONBLE CAT BY MINISTRY OF I&B IS CONTRARY TO THE FACT-HENCE THE ORDER WILL BE CHALLENGED VERY SOON BY FDCP

The speaking order submitted before the Honble CAT against the Contempt Petition is contrary to the facts and illogical and ambiguous before Law.Hence the same will be challenged by our Federation, very soon before the Honble Tribunal for remedy and for Final order for Implementation. With all our members support and co-operation we will achieve the goal very soon.No pain No gain,so we will fight together for reaping the Result at the earliest.Next update will be available as soon as our petition is filed before the Honble Tribunal.

THE EXTRACT OF HONBLE TRIBUNAL ORDER FOR CONTEMPT PETITION FILED BY FDCP BEFORE ERNAKULAM BENCH OF HONBLE CAT

The extract of the Honble CAT order follows :
     "We are not satisfied with the aforesaid replies of the Respondents in the Present M.A and to the C.P(C) filed before us with regard to implementation of this Tribunal order dated 25th October 2011.Since the order is only a direction to the 1st respondent to consider Annexure A-36 and to take a final decision in the matter by the 1st respondent as early as possible as any rate within three months from the reciept of the order,what had to be complied with by the respondent is only to take a decision.This Tribunal in fact does not understand the reason why the respondents are procrastinating in taking a decision and communicating the same to the Applicants.However by way of a gesture of indulgence,thisTribunal is inclined to grant one month time more as finally to consider Annexure A36 representation by the 1st respondent and to pass order.Accordingly M.A no.180/1206/2014 and M.A.no.180/1070/2014 are disposed of."
      Post the Contempt Petition on 10.12.2014.
  Issue a copy of this order to the Learned counsel for the Parties.

CONTEMPT PROCEEDINGS AGAINST SECRETARY I&B INITIATED BY HONBLE CAT ,ERNAKULAM BENCH FOR CP/98/2014 ON 10-11-2014

Contempt proceedings against Secretary I&B has been invoked by Honble CAT, Ernakulam bench for non compliance of it's order dated 25-10-2011 in CP/98/2014 filed by FDCP.The order was delivered in open court on 10-11-2014 and the next date of posting of the contempt matter is on 10-12-2014.As soon as we receive the judgment copy further details will be displayed in this site.The matter published in this site of Fdcp is official and do not believe to other rumours spread by different networks.

Financial Implications Worked out and Pay Parity will be Resolved Very Soon

The FDCP President visited New Delhi on 1/9/2014 and stayed there for a week to Pursue our long pending Wage anomaly issue with the Competent authorities along with the latest Honble CAT order ,Which directed the Respondent"s to pass a final order before 3/10/2014.In response to our tireless efforts the Ministry of I&B has issued a letter to the Prasar Bharati to work out the financial implications and accordingly an Urgent Communication has been sent from Prasar Bharati to the Directorate of Doordarshan on 2/9/2014 to calculate the Financial implications and to send the same to Prasar Bharati Secretariat latest by 5/9/2014.The Directorate has finished the work on 5/9/2014 itself and the same will be submitted to the PB Secretariat soon through Special messenger for onward transmission to the Ministry of I&B, so as to enable the Ministry to get the final approval from the Honble Minister for I&B.The long awaited Wage revision order is expected by the month end.

UPDATE ON FDCP PRESIDENT 'S RECENT NEW DELHI VISIT

The FDCP President visited New Delhi recently and met Honble Mos for Heavy Industries&Public enterprises Shri.Pon.Radhakrishnan and BJP,National Vice President and Rajya Sabha MP Shri.Prabat Jha and our Additional Secretary and I&B Ministry Representative in Prasar Bharati Board Shri.J.S.Mathur and Joint Secretary(Broadcasting-2) Smt.Abha Shukla and discussed our Pay Parity Issue and Submitted a detailed Memorandum along with our Latest Honble CAT Order and Persuaded them to take up our long pending issue for an early settlement through our Honble Minister for I&B.The president,FDCP will again visit New Delhi next month,after parliament session concludes and will meet our Honble Minister for I&B for Speedy implementation of our Case.

THE EXTRACT OF THE HONBLE CAT ORDER Dt 4-7-2014

M.A for implementation
"We wish to impress upon the Respondents that prolonging of the matter under one pretext or the other will not be appreciated as it would only bring in justice to the applicants.Nevertheless,as a final gesture of granting time to the respondents,we direct the respondents to pass an order in relation to the subject matter of this M.A within three months.no further time will be granted.Accordingly the M.A is allowed.Issue a copy of this order to Mr.George Joseph,ACGSC for communicating the same by fax to all concerned"

THE NEXT DATE OF OUR UPGRADATION OF PAYSCALE CASE IS ON 4/7/2014

The President of FDCP visited New Delhi on 16/6/2014 and during his visit he met the competent authorities in the Ministry of I&B and persuaded our wage anomaly issue and pleaded for early settlement.The matter of up-gradation of pay scales has been taken up through BJP Vice President Sh.Prabat Jha and also through some Vip"s for speedy redressal.The next date of our wage anomaly case is listed for Compliance on 4th July 2014.

UPDATE ON OUR PAY REVISION CASE

Today our wage revision case was listed for hearing and the counsel for First respondent,briefed the developments in our case and pleaded for extension of time for taking up the matter with the new Government for issuing the final orders.The Honble Tribunal allowed six weeks time for complying its order.

UPDATE ON UPGRADATION OF PAY SCALES TO OUR PROFESSIONAL CADRES

The President of our Federation met the Additional Secretary of Ministry of I&B and Government of India representative in Prasar Bharati Board Shri.J.S.Mathur on 26/03/2014 in his chamber in New Delhi under the advice of the Secretary,Ministry of I&B and discussed our long pending wage anomaly issue along with the copy of Prasar Bharati Board's communication to the Secretary,Ministry of I&B w.r.t our wage revision ,and the Additional Secretary assured that he will go through our file and take appropriate action.Meantime our President also sought the intervention of Shri.Vijay sharma ,Private Secretary to our Honble Minister for I&B in to our long pending pay parity issue and he also assured that as soon the Matter comes to the Honble Minister the action will be taken at the earliest.

GOM ON PRASAR BHARATI TO TAKE A FINAL DECISION ON OUR PAY PARITY SOON

We met Shri.Bimal Julka ,Secretary, Ministry of I&B on 17/2/2014 in New delhi and discussed in detail about our long pending wage anomaly issue.Smt.Abha Shukla,Joint Secretary{Broadcasting}was also present during our discussion.Both the officials assured that the matter of our wage anomaly will be referred to the Group of Ministers {GOM} very soon for taking a final decision.Mean time some information with regard to our wage anomaly was sought from prasrar bharati and the same was submitted to the Ministry of I&B by Prasar Bharati authorities on 13/2/2014 along with the Prasar Bharati Board"s unanimous decision in our favour which was taken by PB Board on its Meeting held on 7-1-2014.
     We also met Smt.Anu Garg,Joint Secretary in Prime Minister"s office ,who is in-charge of our I&B Ministry and presented our case before her for Expediting an early settlement for our long pending issue, by taking up the matter with our Ministry of  I&B. Shri.Shakil P Ahammed ,Director,PMO was also present during our meeting.Both the officials of the PMO assured their full support and  exploring all possibilities to settle our pay parity issue,on Priority.
    At present the Ministry of I&B is gearing up for a GOM meeting at the earliest to settle our wage anomaly issue.As soon as the GOM Meeting date is fixed the next update will be available in our Blog.

UPDATE ON WAGE ANOMALY ISSUE

The long pending wage anomaly for our professional cadres as per the Honble CAT verdict is getting processed in the Ministry of I&B on priority and it is learned that the wage anomaly issue will be resolved very soon.To ascertain the matter in person and to persuade the competent authorities to expedite the decision at the earliest,the President of FDCP is proceeding to New delhi next week.The next update will be available in the blog , only after the President's New delhi visit.

UPDATE ON OUR WAGE ANOMALY ISSUE:

   The President of our Federation along with Shri.KP.Prasad, Edit supervisor of Ddk,Lucknow and Shri.AS..Ganesh,Film/Video Editor of Ddk,Delhi met Shri.Manish Tewari,Honble Minister for I&B in the Ministry on 10/01/2014 at 12.15 pm and explained the delay in resolving our long pending wage anomaly issue.The Honble Minister along with his Personal staff, heard our crisis with patience and he informed us that the matter is already in the processing and he assured that the matter will be settled soon.
   After our meeting with the Minister,as per his direction another meeting was held in the chamber of Joint secretary {Broadcasting}Smt.Abha Shukla along with other competent authorities and according to the officials,the Agenda for the forthcoming GOM {Group of Ministers} Meeting was already placed before the Prasar Bharati Board Meeting ,which was held on 7-01-2014 for getting the Considered view of the PB Board.Now the Ministry of I&B is expecting the Minutes of the PB Board meeting within a week and after that the matter will be placed before the GOM Meeting very soon for getting the approval of the GOM and thereafter the same will be ratified through the Cabinet for Final Orders.
     Earlier we met the Secretary,Ministry of I&B Shri.Bimal Julka on 10/01/2014 at 10.30 a.m along with the Joint Secretary{Broadcasting}Smt.Abha Shukla and discussed our wage anomaly issue in detail,with regard to our Court case and they assured that the matter will be considered on Priority.An affidavit in this matter will be submitted before the Honble CAT,Ernakulam Bench in the coming Week.
     The Honble Minister for I&B ,the Secretary ,MIB,and the Joint Secretary {Broadcasting}assured their full cooperation and Support to resolve our long pending crisis,as early as possible.
